Gameberry Labs Audio Policy
This policy applies to your download, access, and use of Gameberry Labs' games, whether on your computer, a
mobile device, our website www.gameberrylabs.com (the
“Platform”), or any other platform (accessible on a device or website), specifically with
respect to the audio chat feature made available on the Platform. Your use of our Platform is governed by the
Terms of Service, and your data and information is dealt with as per our Privacy Policy. This Policy is
supplemental to, and must be read together with, the Terms of Service and Privacy Policy. In the event of any
inconsistency between this Policy and the Terms of Service and/or the Privacy Policy, the Terms of Service or
(as may be relevant) the Privacy Policy shall prevail unless this Policy expressly states otherwise in
relation to the audio chat feature.
In this Policy, “Gameberry,” “we,” “us,” and “our” refer to
Gameberry Labs and its apps, platforms, and services.
You must review and accept this Policy before using the audio chat feature, so that we can keep the Platform a
welcoming and secure place for everyone. If you do not agree to the terms of this Policy or any future
updated version, you must not access or use the audio chat feature. If you do not agree to any updated
version of this Policy, you must stop using the audio chat feature from the effective date of such update.
We may notify users of material changes by in-app notice, email, website posting, or other appropriate
electronic means, and may require renewed acknowledgment where required by law or internal compliance
processes. We may also periodically notify users of this Policy and related platform policies, including at
least annually where required by applicable law or internal compliance requirements.
In case of non-compliance with applicable laws, Privacy Policy or Terms of Service, we reserve the right to
terminate the access or usage rights of the users to the Platform immediately or remove non-compliant
information or any other action which we may deem fit.
Our Platform welcomes every user regardless of their gender identity, sexual orientation, race, ethnicity,
language, nationality, colour, social and economic class, education, size, family status, political belief,
religion, mental and physical ability, or any other personal characteristic. We reserve the right to review
and moderate content and media posted on our Platform to prevent discriminatory language, offensive imagery,
and other forms of harassment from disrupting the community.
We do not tolerate bullying or harassment, including derogatory comments based on race, gender identity or
expression, sexual orientation, age, culture, faith, mental or physical abilities, or country of origin. All
members of our community should be treated with dignity and respect. This policy applies to every user with
no exceptions.
1. Usage of Platform
You acknowledge, agree, and undertake the following:
- You represent and warrant that: (a) you are at least 18 years of age; (b) you are legally competent to
contract, have the full right, power and capacity to agree to this Policy; and (c) your use of the
Platform does not violate any applicable law, regulation, contract, court order or legally binding
obligation.
- For the time being, the audio chat is not available to persons under 18 years of age.
- The Platform is not intended for any person barred from receiving or using the services under applicable
law.
2. Nature of the Platform; Intermediary Status
- The Platform is a technology service that enables users to create, host, access, join and participate in
live or recorded audio chat rooms and related interactive features. The Company does not assume any
editorial role in relation to User Content (defined hereafter) merely by hosting, transmitting, ranking,
restricting, reviewing, muting, removing or preserving such User Content in accordance with this Policy
and applicable law.
- The Company acts as an intermediary in relation to user-generated content and user interactions, within
the meaning of applicable law, including Section 2(1)(w) of the Information Technology Act, 2000, to the
extent applicable.
- You acknowledge that: (a) users, and not the Company, are solely responsible for the information,
statements, opinions, audio, recordings, text, usernames, links, and other content that they create,
transmit, host, display, upload, publish, store, share or otherwise make available on or through the
Platform (“User Content”); (b) the Company does not ordinarily initiate the transmission of
User Content, select the receiver of such transmission, or select or modify the information contained in
such transmission, except to the limited extent required for technical processing, formatting, routing,
compliance, safety, moderation, enforcement, security, lawful investigation, or operation of the
services; and (c) the availability of any room, stream, profile, user, or User Content on the Platform
shall not be deemed to mean that the Company endorses, verifies, adopts, promotes or guarantees the
same.
- Nothing in this Policy obligates the Company to pre-screen, monitor or actively police all User Content.
However, subject to and in accordance with the Privacy Policy and applicable laws, the Company reserves
the right, at its sole discretion, to monitor, review, flag, record, restrict, mute, interrupt, remove,
disable access to, or preserve any User Content or user activity for safety, security, legal, regulatory,
operational or business reasons. Any moderation, review, restriction or enforcement activity undertaken
by the Company shall not be construed as assuming responsibility for, or endorsing, any User Content.
- By participating in the Platform, you expressly consent to the contents of this Section 2.
3. Rooms; User Interactions; Recording and Moderation
- The Platform may enable users to create or join live audio rooms, clubs, stages, communities or other
audio interaction spaces (“Rooms”).
- By participating in any Room, you understand and agree that: (a) live audio may be heard by other
participants and, depending on the privacy settings of the Room, by broader categories of users; (b)
(where, and, to the extent permitted under applicable laws) the Company may maintain logs, metadata,
moderation records, reports, safety signals, device data, IP logs, participation history, and other
records relating to Rooms; (c) the Company may, where permitted by law and/or disclosed in our Privacy
Policy or applicable feature disclosures, temporarily buffer, record, store or preserve Room audio or
related information for moderation, complaints handling, fraud prevention, abuse investigation, quality
assurance, legal compliance or law-enforcement cooperation; and (d) participants may capture, record,
note, repeat or misuse statements made in a Room, and the Company cannot guarantee that all participants
will comply with this Policy.
- You should not share sensitive personal data, confidential information, financial credentials, intimate
material, trade secrets, or any information that you do not wish to be heard, stored, repeated, reported
or disclosed. You are solely responsible for the consequences of voluntarily disclosing information in a
Room, including where such information is subsequently repeated, recorded, reported or misused by other
participants.
- We may impose restrictions on Room size, access, discoverability, speaking permissions, moderation tools,
topic categories, scheduling, hosting privileges and geographic availability.
4. Prohibited Content
Users are strictly prohibited from transmitting, streaming, uploading, modifying, or otherwise sharing any
audio, content, or information on the Platform that:
- belongs to another person and to which the user does not have any right;
- is obscene, pornographic, paedophilic, invasive of another’s privacy including bodily privacy,
insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or
encouraging money laundering or gambling, or an online game that causes user harm, or promoting enmity
between different groups on the grounds of religion or caste with the intent to incite violence;
- is harmful to a child;
- infringes any patent, trademark, copyright, or other proprietary rights of any third party (including
unauthorized use of background music);
- deceives or misleads the addressee about the origin of the message or knowingly and intentionally
communicates any misinformation or information which is patently false and untrue or misleading in
nature;
- impersonates another person including through the use of synthetically generated information (SGI), AI
deepfakes, or manipulated audio, deceptive voice cloning, or other techniques intended to mislead users
as to the identity, origin, endorsement or authenticity of the communication;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with
foreign States, or public order, or causes incitement to the commission of any cognisable offence, or
prevents investigation of any offence, or is insulting to any other nation;
- contains software virus or any other computer code, file or program designed to interrupt, destroy or
limit the functionality of any computer resource;
- is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a
permissible online game, or of any online gaming intermediary offering such an online game;
- violates any law for the time being in force;
- promotes, supports, glorifies, incites, or facilitates terrorism or terrorist activities, including the
recruitment, training, financing, or provision of logistical assistance to any terrorist organization or
individual;
- involves, references, or is undertaken on behalf of any person or entity designated under applicable
anti-terrorism, sanctions, or national security laws, or is otherwise in violation of such laws;
- promotes, facilitates, or enables betting, wagering, gambling, or real-money online gaming activities,
including the advertisement, solicitation, or operation of such activities;
- involves, references, or directs users to any platform, service, or arrangement offering betting,
wagering, gambling, or real-money online gaming in contravention of applicable laws or regulations;
- is insulting, abusive, harassing, defamatory, or otherwise highly offensive, including conduct such as
trolling, griefing, taunting, repeated insults, or use of vulgar profanity intended to provoke or harm
another user; and
- is discriminatory, racially, ethnically, or culturally objectionable, or targets or disparages any
individual or group based on protected characteristics, including age, gender identity, ethnicity, caste,
sexual orientation, disability, or religious affiliation.
You agree to indemnify and hold harmless Gameberry Labs from and against any losses, damages, liabilities,
penalties, or statutory or civil claims arising out of or in connection with your breach of this Policy,
including this Section 4. Specifically, you acknowledge and accept that you are responsible for activities
undertaken through your account to the extent resulting from your acts, omissions, negligence, failure to
safeguard credentials, or misuse of your device or authentication methods, except where caused solely by our
proven fault.
5. Harassment
We maintain a zero-tolerance absolute prohibition on harassment. Any escalation of prohibited behaviour will
result in immediate termination of the user’s account and reporting to law enforcement authorities.
Harassment includes, but is not limited to:
- Threatening another user with physical violence, extortion, or property damage, or harassing an
individual.
- Stalking, monitoring, or persistently gathering personal information (doxxing) with the intent to
threaten, harass, or foster apprehension in another user.
- Making sexually coloured remarks, demanding sexual favours, or distributing non-consensual sexual
material.
- Illegal extortion, stalking, physical threats, or systemic discrimination based on protected
classifications.
Serious or repeated violations may result in immediate suspension or termination of the user’s account
and, where appropriate or required by law, reporting to relevant law-enforcement authorities.
6. The Dos and Don’ts on Our Platform
The Dos:
- Treat all members of our community with dignity and respect.
- In all your communication, use language that is respectful and decent. Your language should not be
abusive, harassing, or offensive, and should not disrespect or hurt any individual’s sentiments.
The Don’ts:
- We have a zero-tolerance policy towards any kind of hate speech. There are no exceptions for hateful
words or insults, even if the context is humorous, non-serious, or reappropriated. It is unacceptable to
attack a person or community based on attributes such as their race, ethnicity, caste, national origin,
sex, gender identity, gender presentation, sexual orientation, religious affiliation, age, serious
illness, disabilities, or other protected classifications.
- Users should not use profanity, insult each other, publish offensive content, or use offensive language
on our Platform.
- If there is a chat function available in a game offered by us, be mindful of other people’s
experiences. This includes avoiding excessive posting or spamming.
- Your audio chats should be clean and respectful of all genders, orientations, races, and so on. You
should not share adult content or use adult content in avatars, club pictures, profile pictures, text, or
any other space.
- Our audio chat function is an additional feature alongside the main game app and is to be used
accordingly. We do not entertain or promote chats between individuals discussing anything that is
prohibited by the terms of this Policy.
- We do not allow impersonation of any person. Each individual should only create and access accounts that
belong to them.
- If you have a disagreement or unpleasant interaction with another player, please contact us or report the
player using the options provided within the game on our Platform. Do not publicly shame other Platform
users; doing so constitutes harassment.
- Do not use our Platform and services for organising, promoting, or supporting violent extremism. This
also includes glorifying violent events, the perpetrators of violent acts, sharing extremism, terrorism,
abetting crimes, and similar behaviours. This includes indirect or suggestive threats, as well as sharing
or threatening to share someone’s personally identifiable information.
- Cheating and other unfair play is not permitted. Cheating, including the use of third-party software, is
unacceptable. Exploiting bugs or participating in any other conduct that provides an unfair advantage is
cheating.
- You are responsible for how your account is used. Never share any personal information such as phone
numbers, email addresses, passwords, account information, physical addresses, etc. about yourself or
others.
- The Platform is meant for the purpose of availing services and interaction regarding the same. Users
should not share sensitive content related to politics or religion. It is prohibited to share information
disclosing government secrets, national military information, information related to politics or religion
policies, and information that can disturb social order or social stability.
- Users should not share false or misleading information (misinformation) with any user on the Platform
which makes them believe facts which are not true. False information posted to harass someone, for
financial gain, or to cause any injury to them is prohibited.
- Users must not share real media depicting gore, excessive violence, or animal harm, especially with the
intention to harass or shock others, or any content that violates anyone’s intellectual property or
other rights.
- It is against this Policy to post any content which contains intellectual property, in any manner, that
belongs to a third party, including copyrighted works (unless there is a valid justification for
"fair use" or you have valid permission to use such intellectual property), trademarks,
confidential information, or trade secrets, unless you have valid permission of the relevant owner.
- You must understand that our Platform may be accessed by individuals of all backgrounds and experiences
and may be sensitive to certain types of content or ideas. You must not share content that glorifies or
promotes suicide or self-harm, including any encouragement to others to cut themselves or embrace eating
disorders such as anorexia or bulimia. Self-harm threats used as a form of emotional manipulation or
coercion are also prohibited.
- Each user has the right to decide which accounts they wish to interact with. If a user blocks you from
their account, do not try to contact them from a different account. If a user does not want to engage
with you on the Platform, we urge you to respect that, and vice versa. If we receive a complaint from a
user stating that a blocked account is trying to communicate with them, we can and may take actions to
block or delete the account of such user without any notice.
- You are not allowed to promote any manner of illegal activity.
- We absolutely prohibit any sexualization of or solicitation of minors, and any content that may endanger
their welfare or is shared to harm any minor’s interest, directly or indirectly.
- The Platform is not for the sale of any items by users and shall not be used for the same in any manner
whatsoever. We do not allow or promote the sale of items, or the promotion of items or services, on our
Platform.
- Your identity must be your own at all times. You must not misrepresent or misuse your account in ways
that could be confusing for other users as to your identity. We prohibit the artificial amplification or
suppression of information, like bot audiences, and any attempts to manipulate the Platform to enable
this.
7. Content Rights; Licence to the Platform
- You retain such ownership rights in your User Content as you may have under applicable law, subject to
the rights granted by you under this Policy.
- By submitting, uploading, transmitting, posting, speaking, storing or otherwise making User Content
available on or through the Platform, you grant the Company a worldwide, non-exclusive, royalty-free,
transferable, sub-licensable, revocable (subject to retention obligations under applicable law), licence
to host, store, cache, reproduce, transmit, communicate to the public, display, perform, adapt, format,
translate, excerpt, distribute and otherwise use such User Content solely to: (a) operate, provide and
improve the Platform; (b) enable streaming, routing and technical delivery; (c) moderate content and
enforce policies; (d) investigate complaints, fraud or abuse; (e) comply with legal obligations; (f)
maintain records, backups and evidence; and (g) promote the Platform, where you separately participate in
promotional programs or where such use is otherwise permitted by applicable law and our policies.
- You represent and warrant that: (a) you own or have obtained all rights, licences, consents and
permissions necessary for your User Content and for the grant of rights under this Policy; (b) your User
Content does not infringe any third-party rights; and (c) the use of your User Content by the Company as
contemplated under this Policy will not require payment by the Company to any third party, unless
expressly agreed otherwise in writing.
- If you use music, sound recordings, performances, voice samples, third-party speeches, readings,
podcasts, broadcasts or any copyrighted/protected material in a Room, you are solely responsible for
obtaining all necessary licences, permissions and clearances.
8. Reporting, Takedown, Enforcement and Safe Use
- Users may report Rooms, User Content or accounts through the in-app reporting tools or by contacting the
Grievance Officer / designated support channels.
- We may take any action we deem appropriate, including: (a) warning the user; (b) muting audio or
removing speaking privileges; (c) interrupting or ending a Room; (d) removing or disabling access to
User Content; (e) restricting visibility or discoverability; (f) suspending or terminating an account;
(g) preserving evidence and logs; (h) requiring identity verification; (i) notifying affected persons;
and/or (j) reporting the matter to law-enforcement or regulatory authorities.
- The Company may act upon: (a) user complaints; (b) court orders; (c) directions from governmental
authorities; (d) internal safety detection; (e) trusted flagger inputs; or (f) any other information
suggesting legal, compliance, safety or reputational risk.
- You acknowledge that the Company may be required to remove, disable access to, or preserve certain
content or accounts pursuant to applicable law, court orders, or directions from competent authorities.
- The Company is not obliged to provide prior notice before taking any enforcement action where immediate
action is necessary for safety, fraud prevention, legal compliance, or to prevent harm.
9. Intellectual Property in the Platform
- The Platform, including its software, design, layout, interface, look and feel, trademarks, service
marks, logos, trade dress, graphics, text, compilations, code, features and all related intellectual
property rights, are owned by or licensed to the Company.
- Except for the limited right to use the Platform in accordance with this Policy, no right, title or
interest is granted to you.
- You shall not: (a) copy, reproduce, adapt, distribute, publicly perform, decompile, reverse engineer or
create derivative works of the Platform; (b) use our trademarks without permission; (c) bypass or
interfere with technical protection measures; or (d) use the Platform for unauthorised commercial
exploitation.
10. Storage of Information
While general un-reported audio is ephemeral and not recorded by Gameberry, if a grievance or incident is
reported in the audio chat feature of our app, Gameberry shall, to the extent technically feasible and
available to it, preserve the relevant removed content, complaint or ticket history, and corresponding user
registration records for a minimum period of at least 180 days strictly to facilitate investigations by
authorized law enforcement agencies, to comply with applicable law, etc. After this duration, or upon the
lawful resolution of the investigation, the data may be permanently erased. For the avoidance of doubt,
Gameberry’s obligations under this clause shall be limited to data that is capable of being collected
and retained by it.
11. Third-Party Links and Services
Our games may contain links to third-party websites, services, special offers, content, or other events or
activities that are not owned or controlled by Gameberry Labs. We do not endorse or assume any responsibility
for any third-party sites, information, materials, products, or services. If you access any third-party
website, service, or content from our products, you do so at your own risk and you agree that Gameberry Labs
will have no liability arising from your use of or access to any third-party website, service, or content, or
the accuracy of any outputs generated by these services.
12. Suspension, Restriction and Termination
- We may, with or without notice, temporarily or permanently suspend, restrict or terminate your access to
the Platform or any feature if: (a) you breach this Policy or any other policies; (b) we receive a
complaint, legal notice, court order or governmental direction; (c) your activity creates legal,
regulatory, security, reputational or operational risk; (d) your account appears compromised, fraudulent
or abusive; (e) we are required to do so by law; or (f) we discontinue the Platform or relevant feature.
- Upon suspension or termination: (a) your right to access and use the affected services ceases
immediately; (b) we may remove, disable or preserve relevant content and records; and (c) any provisions
that by nature should survive shall survive, including provisions on indemnity, liability, dispute
resolution, IP, data retention and cooperation with authorities.
- The Company may apply enhanced enforcement measures, including longer suspensions, permanent bans,
device-level restrictions, or loss of feature access, in the case of repeat or serious violations.
13. Disclaimers
- The Platform is provided on an “as is” and “as available” basis.
- To the maximum extent permitted by law, the Company does not warrant that: (a) the Platform will be
uninterrupted, secure or error-free; (b) any Room or user interaction will be safe, lawful, accurate or
suitable; (c) any defect will be corrected; or (d) the Platform will be free from harmful components or
misuse by other users.
- The Company does not guarantee the identity, intent, truthfulness, qualifications or conduct of any user.
- You use the Platform at your own risk, particularly in relation to interactions with strangers, live
discussions, public speech and user-generated content.
14. Limitation of Liabilities
- To the maximum extent permitted by applicable law, the Company, its affiliates, directors, officers,
employees, agents, licensors and service providers shall not be liable for any indirect, incidental,
consequential, special, exemplary or punitive damages, or for any loss of profits, revenue, goodwill,
opportunity, data or reputation, arising out of or in connection with the Platform or this Policy.
- Without prejudice to the foregoing, and to the maximum extent permitted by law, the aggregate liability
of the Company arising out of or relating to the Platform or this Policy shall not exceed the lower of:
(a) the total amount actually paid by you to the Company for the specific service giving rise to the
claim during the six (6) months immediately preceding the event giving rise to the claim; and (b) INR
1,000.
- Nothing in this Policy shall exclude or limit liability to the extent such exclusion or limitation is
prohibited under applicable law.
15. Changes to the Platform and Policy
- We may modify, suspend, discontinue or update the Platform or any feature at any time.
- You must review and accept this Policy before using the audio chat feature, so that we can keep the
Platform a welcoming and secure place for everyone. If you do not agree to the terms of this Policy or
any future updated version, you must not access or use the audio chat feature. If you do not agree to any
updated version of this Policy, you must stop using the audio chat feature from the effective date of
such update.
- We may notify users of material changes by in-app notice, email, website posting, or other appropriate
electronic means, and may require renewed acknowledgment where required by law or internal compliance
processes. We may also periodically notify users of this Policy and related platform policies, including
at least annually where required by applicable law or internal compliance requirements.
- Your continued use of the Platform after the effective date of the revised policy constitutes acceptance
of such revised terms.
16. Governing Law and Dispute Resolution
- Any dispute, controversy or claim arising out of or relating to this Policy or the validity,
interpretation, breach or termination thereof (“Dispute”), including claims seeking redress
or asserting rights under the applicable law shall be amicably settled through mutual consultation and
escalation at such offices of Gameberry as Gameberry may designate. If the Dispute is not settled
amicably as aforesaid within a period of 14 (fourteen) calendar days, the matter would be referred to
arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. Arbitration
shall be presided over by a sole arbitrator mutually appointed by us and the customer.
- The arbitration proceedings shall be conducted in the English language. The venue for the arbitration
proceedings shall be Bengaluru.
- This Policy shall be governed by and construed in accordance with the laws of India and, subject to this
clause, we and you agree and undertake that any controversy or claim arising out of or relating to this
Policy will be adjudicated exclusively before a competent court in Bengaluru, India only.
17. Miscellaneous
- If any provision of this Policy is held invalid or unenforceable, the remaining provisions shall continue
in full force.
- Our failure to enforce any provision shall not operate as a waiver.
- This Policy forms part of the agreement between you and the Company in relation to the audio chat
feature, together with the Terms of Service, Privacy Policy and any other applicable policies or
feature-specific terms.
- You may not assign or transfer your rights or obligations under this Policy without our prior written
consent. We may assign this Policy, in whole or in part, to any affiliate, successor or acquirer.
- Notices may be given through the Platform, by email, by posting updated policies, or by any other
legally recognised mode.
- The Company shall not be liable for any failure or delay in the performance of its obligations under this
Policy if such failure or delay arises out of or is caused by events beyond its reasonable control,
including without limitation acts of God, natural disasters, epidemic or pandemic, war, terrorism, civil
commotion, governmental actions, orders or restrictions, failure of utilities or telecommunications
networks, cyberattacks, or failures of third-party service providers (“Force Majeure
Event”). During the continuance of a Force Majeure Event, the Company’s obligations shall be
suspended to the extent affected. The Company shall use commercially reasonable efforts to resume
performance as soon as practicable.
- If any provision of this Policy is held to be invalid, illegal or unenforceable by a court of competent
jurisdiction, such provision shall, to the extent required, be severed and rendered ineffective without
affecting the validity or enforceability of the remaining provisions of this Policy. To the extent
permitted by applicable law, the parties agree that any such invalid, illegal or unenforceable provision
shall be replaced by a valid and enforceable provision that most closely reflects the original intent and
commercial purpose of such provision.
- You acknowledge and agree that this Policy constitutes an electronic record within the meaning of the
Information Technology Act, 2000 and the applicable rules made thereunder. By accessing or using the
Platform, you consent to the use of electronic records and electronic communications, and agree that all
agreements, notices, disclosures and other communications provided to you electronically satisfy any
legal requirement that such communications be in writing. Your acceptance of this Policy through
electronic means shall constitute a valid and binding agreement between you and the Company.
- The headings in this Policy are for convenience only and do not affect interpretation.

Complaints may include issues relating to: (a) prohibited content; (b) impersonation; (c) privacy violations;
(d) intellectual property infringement; (e) account access issues; (f) unauthorised payments; (g)
non-consensual or abusive conduct; and (h) any other issue notified by the Company.
Complaints should include, to the extent possible: (a) complainant name and contact details; (b) description
of the issue; (c) relevant username / Room / link / screenshot / timestamp; (d) basis of complaint; and (e)
any supporting documents.
We will process complaints in accordance with applicable law and our internal policies. Timelines may vary
depending on the nature of the complaint, urgency, legal requirements and verification needs. We may seek
additional information where reasonably necessary to assess the complaint.
Where required by law, users may also have rights to escalate certain grievances to the appropriate appellate
or statutory forum.
